Terms and Conditions

These Terms and Conditions ("Terms") form an agreement between you and ZingRide Technologies Pvt. Ltd. ("ZingRide", "we", "our", or "us"). They govern your access to the ZingRide website, mobile applications, vehicle-sharing services, messaging channels, Meta Login, WhatsApp Business Platform integrations, and related services (together, the "ZingRide Platform").

By creating an account, connecting a third-party service, booking or listing a vehicle, or otherwise using the ZingRide Platform, you agree to these Terms and our Privacy Policy. Do not use the Platform if you do not agree.

1. Eligibility and Authority

• You must be at least 18 years old and legally capable of entering into a binding agreement.
• You must hold a valid driving licence and meet applicable eligibility requirements before driving a vehicle.
• If you use ZingRide for a business or connect business assets, you confirm that you have authority to bind that business and manage those assets.
• You must provide accurate, current, and verifiable information.

2. Accounts and Security

You are responsible for activity under your account and for protecting passwords, OTPs, access tokens, and connected accounts. Notify us promptly of unauthorized access. We may require identity, vehicle, business, or authority verification and may reject, suspend, or restrict accounts where verification fails.

3. Meta Login and Connected Assets

If you use Meta Login or connect a Meta business asset, you authorize ZingRide to access only the permissions and information displayed in the Meta authorization flow and approved by you. You represent that you are authorized to connect and manage those assets.

You may revoke permissions through Meta settings. Revocation may disable related ZingRide features. Your use of Meta products is also governed by Meta's applicable terms and policies.

4. WhatsApp Business Platform

If you connect or use WhatsApp Business Platform features through ZingRide, you agree to:

• Comply with the WhatsApp Business Terms, WhatsApp Business Messaging Policy, Meta Platform Terms, applicable commerce policies, and all applicable laws.
• Message only people who have provided the consent or opt-in required for the message and maintain evidence of that consent.
• Honour opt-out requests promptly and avoid spam, deception, harassment, prohibited content, or unlawful communications.
• Use approved message templates where required and provide accurate business and message-template information.
• Protect customer information and limit access to authorized personnel.

Meta or WhatsApp may review, reject, limit, suspend, or terminate business accounts, phone numbers, templates, messages, permissions, or API access. ZingRide does not control those decisions and is not responsible for interruptions caused by them.

5. Hosts and Vehicle Listings

Hosts must list only vehicles they are legally authorized to share. Listings must be accurate, and vehicles must remain registered, insured, roadworthy, clean, and compliant with applicable law. Hosts must disclose material restrictions or defects, honour confirmed bookings, and cooperate with safety, insurance, and dispute processes.

6. Renters and Bookings

Renters must use vehicles lawfully and responsibly, follow booking restrictions, inspect the vehicle, report damage or safety issues, and return the vehicle at the agreed time and condition. The renter is responsible for fines, tolls, violations, misuse, and damage attributable to the rental period, subject to applicable law and insurance.

7. Payments, Fees, and Refunds

Prices, deposits, taxes, service fees, cancellation terms, and refund eligibility will be shown during booking or in the applicable policy. Payments may be processed by third-party providers. Hosts authorize ZingRide to deduct applicable fees, refunds, adjustments, or amounts due before payout.

8. Communications and Consent

You agree to receive service communications needed to operate your account or booking, including OTPs, confirmations, safety alerts, receipts, and support messages. Marketing communications will be sent only where permitted and may be stopped using the stated opt-out method. Carrier or data charges may apply.

9. Acceptable Use

You must not:

• Use the Platform or a vehicle for illegal, fraudulent, unsafe, abusive, or unauthorized activity.
• Provide false information, impersonate another person, or access assets without authority.
• Bypass security, interfere with the Platform, scrape data, distribute malware, or reverse engineer protected components except where law permits.
• Conduct prohibited off-platform transactions or misuse personal information obtained through ZingRide.
• Use Meta or WhatsApp data for surveillance, discrimination, data brokerage, or any purpose unrelated to the approved user-facing service.

10. Third-Party Services

The Platform relies on services provided by Meta, WhatsApp, payment processors, identity providers, insurers, cloud providers, and other third parties. Their services are governed by their own terms. We do not guarantee the availability, approval, or performance of third-party services.

11. Intellectual Property

ZingRide and its licensors own the Platform, branding, software, designs, and content, excluding user content and third-party materials. We grant you a limited, revocable, non-transferable right to use the Platform for its intended purpose. You may not copy or exploit ZingRide intellectual property without permission.

12. User Content

You retain ownership of content you submit. You grant ZingRide a non-exclusive licence to host, reproduce, display, transmit, and use that content as needed to operate, secure, improve, and promote the Platform. You confirm that you have the rights required to submit the content and that it does not violate law or third-party rights.

13. Suspension and Termination

We may investigate, restrict, suspend, or terminate access where reasonably necessary for safety, legal compliance, non-payment, suspected fraud, policy violations, third-party platform requirements, or protection of users and the Platform. You may stop using ZingRide and request account deletion at any time, subject to outstanding obligations and lawful retention.

14. Disclaimers

The Platform is provided on an "as is" and "as available" basis to the extent permitted by law. ZingRide is a technology intermediary connecting hosts and renters and does not manufacture vehicles or guarantee every user's conduct. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

ZingRide is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or WhatsApp LLC. Meta and WhatsApp are independent third-party service providers.

15. Limitation of Liability

To the maximum extent permitted by law, ZingRide will not be liable for indirect, incidental, special, punitive, or consequential loss, loss of profits or data, or third-party platform interruptions. ZingRide's aggregate liability relating to a booking will not exceed the amount paid to ZingRide for that booking, except where liability cannot legally be limited.

16. Indemnity

You agree to indemnify ZingRide and its personnel against third-party claims, losses, and reasonable costs arising from your unlawful use, breach of these Terms, vehicle misuse, content, messaging activity, or violation of another person's rights, to the extent permitted by law.

17. Privacy and Data Deletion

Our Privacy Policy explains how we process information. Instructions for deleting account, Meta Login, and WhatsApp integration data are available on our Data Deletion page.

18. Changes

We may update these Terms to reflect changes in services, law, or third-party requirements. Revised Terms will be posted at this URL with an updated date. Continued use after the effective date constitutes acceptance where permitted by law.

19. Governing Law and Disputes

These Terms are governed by the laws of India. Subject to applicable consumer law, courts in Chennai, Tamil Nadu, India will have exclusive jurisdiction over disputes relating to these Terms or the ZingRide Platform.
